This is a legal agreement (“Agreement”) between you and Houseoffetish.co.uk
(“Houseoffetish”) a platform brand established in England UK, which
may be contacted at Admin@Houseoffetish.co.uk. By accessing through way
of registration and or login to the Houseoffetish website, currently located at
www.Houseoffetish.co.uk then proceeding to use any of the Services (as defined below) accessible through the website, you become a user and agree to, and are bound by, the terms and conditions of this Agreement for as long as you continue to use the website, or Services. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, DO NOT USE THE WEBSITE, OR THE SERVICES PROVIDED. Your use of, or participation in,
certain Services may be subject to additional terms, and such terms will be
either listed in this Agreement or will be presented to you for your acceptance
when you sign up to use such Services.

The Houseoffetish.co.uk services consist of the following, without
limitation: a service for individuals (“Findom Service”), interactive
content and online community services such as Standard or Premium services
offered by or on behalf of Houseoffetish. Houseoffetish may offer additional
services or revise any of the Services, at its discretion and with or without
notice, and this Agreement will apply to all additional services or revised
Services. Houseoffetish also reserves the right to cease offering any of the
Services at any time.

This Agreement is subject to change by Houseoffetish in its sole
discretion at any time, with or without notice. Your continued use of this Website
or the Services after the posting of revisions to this Agreement will
constitute your acceptance of such revisions. Please see the end of this
Agreement to determine when the Agreement was last revised.

1. Eligibility.

Minimum Age. You must be at least 18 years old to use the
Website or register for the Services. By using the Findom Service, you
represent and warrant that you are at least 18 years old. Other Services
may have other age requirements for all or portion of such Services, and
such other age requirements are stated on such Services or portions
thereof.
Criminal History. HOUSE OF FETISH DOES NOT CURRENTLY CONDUCT CRIMINAL BACKGROUND SCREENINGS ON ITS MEMBERS.
You are solely responsible for taking appropriate safety precautions in
connection with your use of the Website or Services, as more fully set
forth in Section 2 below.

2. Use of Website
and Services.

As a user of the Website or a user registered to use any of the Services
(a “Registered User”), you agree to the following:

Exclusive Use. Your account is for your personal use only.
You may not authorise others to use your account, and you may not assign
or otherwise transfer your account to any other person or entity. You are
responsible for keeping your user name and password(s) confidential. You
acknowledge that Houseoffetish is not responsible for third party access
to your account that results from the sharing by you or the theft or
misappropriation of your user names and passwords.
Geographic Limitations. The Website and Services are intended for use in the United Kingdom. You agree that you will only use the Services in a manner consistent with this Agreement and any and all applicable local, state, national and international laws and regulations. Registration for, and use of, the Services are void where
prohibited. To the extent that the Services are not legal in your
jurisdiction, you may not use the Services. The Services may not be used
where prohibited by law.
Information Submitted. You are solely responsible for, and assume all liability regarding, (i) the information and content you contribute to the Services; (ii) the
information and content you post, transmit, publish, or otherwise make
available (hereinafter “post”) through the Services; and (iii) your interactions with other Registered Users through the Services. For details
of how Houseoffetish may use information you provide or post visit our Privacy
Policy.
Risk Assumption and Precautions. You assume all risk when using the Services, including but not limited to all of the risks associated with any online or offline interactions with others, including dating. You understand that Houseoffetish is unable to guarantee the accuracy of information provided to you by or about other
Registered Users, and that Houseoffetish is unable to confirm that any
Registered User is who he or she claims to be. Houseoffetish does not
warrant and is not responsible for ensuring that Registered Users or other
users of the Services are in compliance with the Agreement. You agree to
take all necessary precautions when communicating with or meeting
individuals through our website.
No Guarantee. Houseoffetish cannot guarantee successful
communication with other members. Houseoffetish has no obligations to but
will always endeavour to employ and develop new measures to secure and
deliver any content paid for by our users, whilst using our website.
However Houseoffetish cannot guarantee that content will be exchanged as
initially agreed between members; nor can we guarantee content
successfully delivered to you will satisfy your expectations.
Reporting of Violations. You will promptly report to Houseoffetish (i) any violation of the Agreement by others, including but not limited to, other Registered Users of which you become aware, and (ii) any known or suspected unauthorised access to your account.
Content Removal. Houseoffetish reserves the right, but has no
obligation, to monitor the information or material you submit to the
Services or post in the public areas of the Services. Houseoffetish will
have the right to remove any such information or material that in its sole
opinion violates, or may violate, any applicable law, either the letter or
spirit of this Agreement, or upon the request of any third party.
Posting and Communication Restrictions. You will not post on any of the Services, transmit to other users, communicate any content (or links thereto), or otherwise engage in any activity on the Website, that:
1. promotes racism, bigotry, hatred or unwarranted physical harm of
  any kind against any group or individual;
2. is intended to or tends to harass, annoy, threaten or intimidate
  any other users of the Website or Services;
3. is defamatory, inaccurate, abusive, offensive, or otherwise
  objectionable;
4. contains others’ copyrighted content (e.g., music, movies, videos,
  photographs, images, software, etc.) without obtaining permission first;
5. contains video, audio photographs, or images of another person
  without his or her permission (or in the case of a minor, the minor’s
  legal guardian);
6. promotes or enables illegal or unlawful activities, such as
  instructions on how to make or buy illegal weapons or drugs, violate
  someone’s privacy, harm or harass another person, obtain others’ identity
  information, create or disseminate computer viruses, or circumvent
  copy-protect devices;
7. intended to defraud, swindle or deceive other users of the Services;
8. contains viruses, time bombs, trojan horses, cancelbots, worms or
  other harmful, or disruptive codes, components or devices;
9. promotes or solicits involvement in or support of a political
  platform, religion, cult, or sect;
10. disseminates or otherwise discloses another person’s personal
  information without his or her prior permission, or collects or solicits
  another person’s personal information for commercial or unlawful
  purposes;
11. is off-topic, meaningless, or otherwise intended to annoy or
  interfere with others’ enjoyment of the Website;
12. impersonates, or otherwise misrepresents affiliation, connection
  or association with, any person or entity;
13. solicits gambling or engages in any gambling or similar activity;
14. uses scripts, bots or other automated technology to access the Website
  or Services;
15. uses the Website for chain letter, junk mail or spam e-mails;
16. collects or solicits personal information about anyone under 18
  years of age (or the age of majority in your jurisdiction, if it is
  older);
17. is in any way used for or in connection with spamming, spimming,
  phishing, trolling, or similar activities; or
18. Contains any materials which infringe or violate any third party’s
  right(s).
No False Information. You warrant that you will not provide inaccurate, misleading or false information to Houseoffetish or to any other user. If information provided to Houseoffetish or another user subsequently becomes inaccurate, misleading or false, you will promptly notify Houseoffetish of such change.
No Advertising or Commercial Solicitation. You may not transmit any chain letters, junk or spam e-mail to other users. Further, you will not use any information obtained from the Services in order to contact, advertise to, solicit, or sell to any user without their prior explicit consent. If you breach the terms of this
subsection and send or post unsolicited bulk email, “spam” or
other unsolicited communications of any kind through the Services, you
acknowledge that you may cause substantial harm to Houseoffetish.
No Harassment of Houseoffetish Employees or Agents. You will not harass, annoy, intimidate or threaten any Houseoffetish
employees or agents engaged in providing any portion of the Services to
you.

3. User Information

Privacy Policy. For information about the collection and
possible use of information and material provided by you, please click on Houseoffetish’s
Privacy policy located on the Website. By using the Website, you are
consenting to the terms of Houseoffetish’s Privacy
Policy.
Disclosure by Law. You acknowledge and agree that Houseoffetish may disclose information you provide if required or permitted to do so by law, at the request of a
third party, or if we, in our sole discretion, believe that disclosure is
reasonable to (1) comply with the law, requests or orders from law
enforcement, or any legal process (whether or not such disclosure is
required by applicable law); (2) protect or defend Houseoffetish’s or a
third party’s rights; or (3) protect someone’s life, health or safety,
such as when harm or violence against any person (including the user) is
threatened.
Disclosure to Protect Abuse Victims. Notwithstanding any other provision of this Agreement or the Privacy Policy, Houseoffetish reserves the right, but has no obligation, to disclose any information that you submit to the Services, if in its sole opinion, Houseoffetish suspects or has reason to suspect, that the information involves a party who may be the victim of abuse in any form. Abuse may include, without limitation, elder abuse, spousal abuse, neglect, or domestic violence. Information may be disclosed to authorities that Houseoffetish, in its
sole discretion, deems appropriate to handle such disclosure. Appropriate
authorities may include, without limitation, law enforcement agencies,
or court officials. You hereby acknowledge and
agree that Houseoffetish is permitted to make such disclosure.
Use of Anonymous Information for Research. By using the Services, you agree to allow Houseoffetish to use anonymised information from you and your experiences, in order to improve Services. Research conducted may be published in academic journals. However, all identification details will be made anonymous.

4. Content

Our Service allows you to post, link, shop, share and otherwise
make available certain information, text, graphics, videos, or other material
(“Content”). You are responsible for the Content that you post to the
Service, including its legality, reliability, and appropriateness. Content
including blood, violence and other offensive material is prohibited. By
posting Content to the Service, you grant us the right and license to use,
modify, publicly perform, publicly display, reproduce, and distribute such
Content on and through the Service. You retain any and all of your rights to
any Content you submit, post or display on or through the Service and you are
responsible for protecting those rights. You agree that this license includes
the right for us to make your Content available to other users of the Service,
who may also use your Content subject to these Terms. You represent and warrant
that: (i) the Content is yours (you own it) or you have the right to use it and
grant us the rights and license as provided in these Terms, and (ii) the
posting of your Content on or through the Service does not violate the privacy
rights, publicity rights, copyrights, contract rights or any other rights of
any person.

5. Disclaimer of Warranty

No Warranties. This section will apply to the maximum
extent permitted by applicable law. Houseoffetish provides the Services
with reasonable skill and care, and except as expressly provided in this
Agreement, does not make or grant (and hereby excludes) any warranties,
representations, conditions or terms of any kind, whether express,
implied, statutory or otherwise with respect to the Website (including all
information contained therein), including but not limited to any implied
warranties of merchantability, satisfactory content or quality, fitness
for a particular purpose or non-infringement. Houseoffetish does not
warrant that your use of the Services will be secure, uninterrupted,
always available, error-free or will meet your requirements, or that any
defects in the Services will be corrected. Houseoffetish disclaims
liability for, and no warranty, representation, condition or other term is
made with respect to, the connectivity and availability of the Services.

6. Limitation of
Liability

Incidental Damages. To the maximum extent permitted by applicable law, in no event will Houseoffetish be liable for any loss of profits or for any incidental, special, consequential or indirect damages arising out of or relating, directly or indirectly, to the use or inability to use the Website, including, without limitation, damages for loss or corruption of data or programs, service interruptions and procurement of substitute services, even if Houseoffetish knows or has been advised of the possibility of such damages.
Aggregate Liability. Under no circumstances will Houseoffetish’s aggregate liability, in any form of action whatsoever in connection with this Agreement or the use of the Website.
No Liability for non-Houseoffetish Actions. To the maximum extent permitted by applicable law, in no event will Houseoffetish be liable for any claims, losses or damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the Website, including without limitation, bodily injury, emotional distress, and/or any other claims, losses or damages resulting from communications or meetings with other Registered Users of the Services. This includes any claims, losses or damages arising from the conduct of users who have registered under false pretences or who attempt to defraud or harm you.
Information Verification. Houseoffetish may use various ways of verifying information that users have provided. However, none of those ways are perfect, and you agree that Houseoffetish will have no liability to you arising from any incorrectly verified information.
No Exclusions. Nothing in this Agreement shall limit or exclude Houseoffetish’s liability for (i) death or personal injury arising from Houseoffetish’s negligence (as such term is defined by the Unfair Contract Terms Act 1977); or (ii) fraud or fraudulent misrepresentations by Houseoffetish

7. Indemnification

To the maximum extent permitted by applicable law, you agree to
indemnify, defend and hold harmless Houseoffetish, its officers, directors,
employees, agents and third parties, for any claims, causes of action, debts,
losses, costs, liabilities and expenses (including reasonable legal fees)
relating to or arising, directly or indirectly, out of (a) your use of or
inability to use the Website or Services, (b) any user postings made by you,
(c) your violation of any terms of this Agreement or your violation of any
rights of a third party, or (d) your violation of any applicable laws, rules or
regulations. Houseoffetish reserves the right, at its own cost, to assume the
exclusive defence and control of any matter otherwise subject to
indemnification by you, in which event you will fully cooperate with Houseoffetish
in asserting any available defences.

9. Communication
and Privacy

In accordance with our Privacy Policy, we may use your email address to
send you messages notifying you of important changes to the Services or special
offers. Further, we may contact you by telephone if you voluntarily provide us
with your telephone number, in order to communicate with you regarding the
Services.

10. Subscriptions

Some parts of the website are billed on a subscription basis
(“Subscription(s)”). You will be billed in advance on a recurring and
periodic basis (“Billing Cycle”). Billing cycles are set on a monthly
basis. At the end of each Billing Cycle, your Subscription will
automatically renew under the exact same conditions unless you cancel it or houseoffetish.co.uk cancels it. You may cancel your Subscription renewal either through your online account management page on CCBill or by contacting houseoffetish.co.uk admin. Removing your shop does not automatically stop payments.

A valid payment method, CCBill, is
required to process the payment for your Subscription. You shall provide Houseoffetish
with accurate and complete billing information including full name, address, postcode, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Houseoffetish to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, Houseoffetish
will suspend your account until payment is received.

11. Term and
Termination

This Agreement will become effective upon your acceptance of the
Agreement by your use of the Website (or, where relevant, when you expressly
accept this Agreement when registering as a Registered User) and will remain in
full force and effect unless and until terminated hereunder. You hereby agree
that the Services shall immediately commence and be fully available to you upon
registration and the subscription of any Premium Service. Either you or Houseoffetish
may terminate your account at any time, for any reason or no reason, without
explanation, effective upon sending written notice to the other party. Houseoffetish
reserves the right to immediately suspend or terminate your access to any of
the Services, without notice, for any reason or no reason. We also reserve the
right to remove your account information or data from our Services and any
other records at any time at our sole discretion. In the event your access to
any of the Services is suspended due to the breach of this Agreement, you agree
that all fees then paid to Houseoffetish by you will be non-refundable and all
outstanding or pending payments will immediately be due. Following any
termination of any Registered User’s use of the Service, Houseoffetish reserves
the right to send a notice thereof to other Registered Users which whom you
have corresponded.

12. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

13. Cancellations of Your Account

Cancellation at Any Time with No Refund . You may cancel your registration or subscription to any Services at any time during the term of such registration or subscription. You may cancel your Subscription by sending a notice of cancellation to: Admin@Houseoffetish.co.uk, such notice being effective upon our receipt. Please include the e-mail address associated with your Houseoffetish account in this notice. In each case, your subscription will terminate at the end of the subscription term for which you have already paid, and you will not receive any refund for any unused days of such subscription term.

Delivery of Service. Upon successful payment of subscription, your account with Houseoffetish will automatically and immediately be able to access the services.

14. Refunds

Except when required by law, paid Subscription fees are non-refundable.

15. Links To Other Web Sites

Our Service may contain links to third-party web sites or services
that are not owned or controlled by Houseoffetish.

Houseoffetish has no control over, and assumes no responsibility
for, the content, privacy policies, or practices of any third party web sites
or services. You further acknowledge and agree that Houseoffetish shall not be
responsible or liable, directly or indirectly, for any damage or loss caused or
alleged to be caused by or in connection with use of or reliance on any such
content, goods or services available on or through any such web sites or
services.

We strongly advise you to read the terms and conditions and privacy
policies of any third-party web sites or services that you visit.
